What Are The Grounds for Divorce In Nevada? Nevada is a “no fault” state, and one party cannot prevent the other party from obtaining a divorce so long as the minimal jurisdictional requirements are met and at least one of the Parties no longer wants to be married to the other Party. The grounds for divorce in Nevada are:
- Incompatibility of husband and wife
- Insanity existing for 2 years
- When the husband and wife have lived separate and apart for 1 year without cohabitation.
I Reside In Nevada But My Husband Lives In Another State. Can I File For Divorce in Nevada? Yes. The District Court in Nevada has jurisdiction to enter a Decree of Divorce so long as either your or your spouse resided in Nevada for at least 6 weeks prior to the divorce action being filed with the Court.
How Long Does It Take To Obtain A Divorce In Nevada? It depends. The circumstances of each case are different, but much will depend on whether your divorce is uncontested or contested. If you and your spouse are able to resolve the monetary issues (i.e. division of money, assets and debt) and child custody and visitation issues, then your case will be completed much faster than if you fight. Generally, an uncontested action will take between 2-6 weeks. However, a contested matter will likely take 6 months or more to complete.

How Much Does Law Practice, Ltd. Charge To Handle My Divorce? The legal fees which we charge to handle your divorce may vary depending on the circumstances of your situation.
However, below are some general guidelines:
- Uncontested Joint Petition For Divorce (No Assets or Debt to Divide and No Children): This is a truly uncontested matter, where both Parties are in agreement on ALL issues. We charge a fixed flat fee of $750 plus costs.
- Divorce (No Children): We will require you to provide our firm with an Initial Retainer in the sum of $2,500.00. You will be charged the sum of $250 per hour for legal services performed.
- Divorce (With Children): We will require you to provide our firm with an Initial Retainer in the sum of $ 2,500-$5,000.00. You will be charged the sum of $250 per hour for legal services performed.
Will My Retainer Cover the Entire Cost of My Divorce? Not necessarily. If we are able to resolve the monetary and child custody issues with your spouse quickly, the amount of your initial retainer may be sufficient. However, if this is a contested matter, the time spent by Law Practice, Ltd. to complete your divorce may exceed the amount of the initial retainer which you provided. In that case, you will be asked to either replenish the retainer and/or billed per hour on a monthly basis. The fees for many contested divorces range between $3,500-$7,500.00. Rarely, but sometimes, a contested divorce can cost in excess of $10,000.00 in fees.
Does Law Practice, Ltd. Charge An Initial Consultation Fee? Yes. We charge an initial minimal consultation fee of $150.00 to discuss your case with one of our family law attorneys. Your initial consultation appointment will last approximately 30-45 minutes. However, this Initial Consultation fee will be waived if you retain Law Practice, Ltd. to represent you in your divorce case.
