What are the grounds for divorce in Nevada?
Nevada is a no-fault state, and one party cannot prevent the other party from obtaining a divorce so long as the minimal jurisdictional requirements are met and at least one of the parties no longer wants to be married.
The grounds for divorce in Nevada are:
- Incompatibility of husband and wife
- Insanity existing for two years
- When the husband and wife have lived separate and apart for one year without cohabitation
I reside in Nevada but my husband lives in another state. Can I file for divorce in Nevada?
Yes. The District Court in Nevada has jurisdiction to enter a decree of divorce so long as either you or your spouse resided in Nevada for at least six weeks prior to the divorce action being filed with the court.
How long does it take to obtain a divorce in Nevada?
It depends. The circumstances of each case are different, but much will depend on whether your divorce is uncontested or contested. If you and your spouse can resolve property division, child custody, and support issues, your case will be completed much faster than if you fight. Generally, an uncontested action will take between two and six weeks. However, a contested matter will likely take six months or more to complete.
